Why Are They Not Suing You? - HomeEquity Bank
We received a message on the weekend from a visitor who had a few questions, the most pressing of which, to them, is why are these multi-million and multi-billion-dollar financial corporations not suing into silence our small, not-for-profit, social enterprise community media service that donates all services to any charity, not-for-profit, or benevolent community groups that asks.
The reasons are not hard to understand.
- We are telling the truth, and contrary to dramatic storylines in the movies and TV, the courts are based on evidence, which we have in abundance.
- Recently, the Supreme Court of Canada issued new law to dissuade Strategic Litigation Against Public Participation (SLAPP), which is abusive civil action filed by a wealthy person or corporation to silence the truth about themselves. Such a dismissal would be costly and humiliating.
- We are a benevolent community organization that has donated hundreds of thousands of dollars in services to our community's charities and other not-for-profit groups. In sharp contrast, Verico the Mortgage Station, Verico Financial Group Inc. and HomeEquity Bank have defrauded senior and veteran clientele, or they have helped to cover up the indictable offence of usury. The exposure of using civil action to conceal would be self-damaging.
- We now know quite a few details about Verico the Mortgage Station, Verico Financial Group Inc. and HomeEquity Bank, that these 'trusted financial professionals' would likely not want released to the public, as would occur if it was argued in a court of law. Most of that intel has been provided by former members of management and staff. If civil action is filed by any of those corporations, which we would very much welcome, they know we can and will summons the CEOs and Presidents of all three provincially licensed financial corporations, whom we will question under oath against the evidence we have accumulated throughout the past two and a half years of research.
- We will also be within our rights to demand the surrender of certain documents, like any and all communications relevant to the case between the directors of Verico the Mortgage Station, Verico Financial Group Inc. and HomeEquity Bank, going back to the time of the mortgage negotiations, and forward to the day of trial. The risk of them being compelled by a court of law to admit to certain facts, of which we have the evidence, has been enough to cause them to hide in the darkness rather than stepping up in an ethical manner, so imagine why the prospect of having to surrender all those details would scare them.
- Essentially all of our principal claims are more than two years old, and have never been challenged by any identifiable person, which means they are considered by the court to be factual and uncontested.
- We have an impressive record of standing up against 'legal' bullying by big corporations who want to silence our reporting. Despite for the most part being self-represented, and in one case challenging nine lawyers from three Bay St. law firms, we have consistently won in every venue of litigation. In each of those cases, we posted updates on the action and shared all the documentation, including affidavits, etc. The transparently abusive actions of the directors of those corporations caused their clients to drop their services, resulting in the aggressor businesses going bankrupt. In short, despite having every advantage, they lost everything to those they wrongly perceived to be weak. The directors of Verico the Mortgage Station, Verico Financial Group Inc. and HomeEquity Bank are now learning the truth of this reality, as the once respected brokerage are losing staff at a phenomenal rate, are being forced to turn offices meant for an expansion into apartments for cash flow, and their newly built custom office space is now for sale.
- Our media service has a long history of taking on injustices committed against people who have no voice or who are not capable of fighting for themselves. Most recently, our services have been utilized to deter the Mayor of Barrie from abusing the Charter rights of the homeless community, but we have also successfully challenged the authority of an abusive police detective, resulting in his apparent demotion to evidence room attendant, we exposed a con-artist landlord who defrauded dozens of struggling single mothers, and we brought public shame and action by the City of Barrie to a slumlord whose negligence contributed to the freezing death of a disabled man. In response to our reporting, our Producer, a former international journalist and war correspondent, has been threatened with civil action, arrested as a means of intimidation, and even shot at by drive-by shootings. Regardless, we have never lost in court, never been convicted of any crimes, and have not been deterred from telling the full truth, no matter what threats and abuses of power have been used to try to silence us.
- Our reputation for supporting charity within our community resulted in our team being nominated and voted to the highest levels for the 2020 'Paying It Forward' award for altruism, presented by the City of Barrie and the Chamber of Commerce. As such, it would be extremely hard for any lawyer to present a case supporting the claim made by David Flude, the Principal Broker and believed owner of Verico the Mortgage Station, who libelously claimed to a prospective client that our Producer was nothing but a 'serial agitator'. That woman and several of those we have assisted through charity donations have offered to speak in support of our honesty and dedication to the community.
- Five Points Media is a provincially registered media service that has been in operation since 2014. As journalists, we are reporting the truth, which the directors of Verico the Mortgage Station, Verico Financial Group Inc. and HomeEquity Bank have defacto confirmed through their decision to take no action in civil court, nor to contest our allegations through direct communications. Our right to report the facts, as we are doing, is protected under section 2B of the Charter of Rights and Freedoms. Our right to report the truth is also protected by various sections of Canadian Bill of Rights, and internationally by article 19 of the Universal Declaration of Human Rights; article 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms; article 13 of the American Convention on Human Rights; and in the US by the First Amendment of the American Constitution.
- We have presented evidence and made assertions of 'motivated' actions by officers of the South Simcoe Police Service who omitted key evidence and used fraudulent figures to provide a 'get out of jail free' pass to the brokers of Verico the Mortgage Station. We have also published about how the councillors of Simcoe County Council chose unanimously to simply ignore the clearly criminal actions and risk to seniors resulting from the fraud by usury committed by Renee Dadswell, Lisa Purchase, and David Flude. Regardless, not one of these people, elected officials or police, have ever contested our allegations, nor have we heard from legal representation for any of them. Given the very public nature of our reporting, this suggests that those public entities want nothing more to do with this matter, and that life could become very awkward for the brokers of Verico the Mortgage Station, and their presumed former collaborators at Verico Financial Group Inc. and HomeEquity Bank if we were to summons any of them to provide evidence at trial, or serve either with a court demand for emails and other potential evidence.
There are several more reason, including an explanation as to why the directors of Verico the Mortgage Station, Verico Financial Group Inc. and HomeEquity Bank have not contested our allegations for more than two years, or even agreed to meet to discuss their side of the story. People know that elephants do not really hide from the mouse, and their fear of confronting this issue, regardless of the David and Goliath status of the two sides, just screams guilty based solely on the facts and history.
